# Acceptable Use Policy

## 1. Purpose

This Acceptable Use Policy ("AUP") sets out the rules for how you may — and may not — use the **MarigoldShare** platform (the "Services"). This AUP is incorporated into and forms part of the MarigoldShare Terms of Service. By using the Services, you agree to comply with this AUP.

The goal of this policy is to maintain a safe, trustworthy, and respectful environment for all Members of the MarigoldShare community.

## 2. Permitted Uses

You may use MarigoldShare to:

- List any physical Item you own or are legally authorized to lend, subject to the item category rules in Section 4.
- Browse, discover, and borrow Items from other Members in your community.
- Communicate with other Members regarding Item availability, condition, and rental logistics.
- Participate in community features such as groups, announcements, and community events (if available).

## 3. Prohibited Uses

### 3.1 Fraudulent or Deceptive Activity

You may not:

- Create fake accounts, impersonate another person, or misrepresent your identity or affiliation.
- List Items you do not own or do not have authority to lend.
- Provide false, misleading, or inaccurate information in your profile, Item listings, or communications.
- Declare a replacement cost that you know to be materially inaccurate, whether to circumvent the $300 platform ceiling or to inflate recovery in a dispute.
- Submit fraudulent dispute claims or fabricate evidence in a dispute.
- Use another Member's account without their authorization.

### 3.2 Illegal Activity

You may not use the Services to:

- Facilitate or engage in any activity that violates local, state, national, or international law.
- List or transact in Items that are stolen, illegally obtained, or subject to a legal claim or encumbrance.
- Launder money or conduct fraudulent financial transactions.
- Harass, stalk, threaten, or intimidate any person.
- Discriminate against Members on the basis of race, color, religion, gender, gender identity, sexual orientation, national origin, disability, age, or any other protected characteristic.

### 3.3 Abusive Conduct

You may not:

- Post or transmit content that is abusive, defamatory, hateful, threatening, or obscene.
- Harass, bully, or persistently contact a Member who has indicated they do not wish to communicate with you.
- Leave retaliatory, false, or malicious reviews or ratings.
- Encourage or incite other Members to violate this AUP or the Terms of Service.

### 3.4 Payment and Dispute System Abuse

The bill splitting and payment acknowledgment system depends on good-faith participation by all Members. You may not:

- Deliberately withhold acknowledgment of a payment you have made or received in order to trigger or prolong a dispute.
- Submit false payment acknowledgments or deny receipt of a payment you have received.
- Fabricate, alter, or misrepresent payment records, receipts, or communications in connection with a dispute.
- Attempt to manipulate the bill splitting calculation by misrepresenting rental agreements or transaction amounts.
- File repeated or bad-faith dispute submissions to harass another Member or exploit the dispute resolution process.
- Abuse the admin mediation process by providing false information to community admins or super admins.
- Use a partial payment — or a claim of partial payment — as a tactic to delay, reduce, or avoid a legitimate payment obligation rather than as a good-faith effort to resolve a genuine dispute about a specific underlying rental transaction. The partial payment dispute resolution process exists to fairly address genuine disagreements about specific transactions, not to provide a mechanism for reducing valid payment obligations.

### 3.5 Platform Integrity

You may not:

- Scrape, crawl, or otherwise extract data from the Services using automated means without express written permission from Marigold Intelligence LLC.
- Reverse engineer, decompile, or attempt to extract the source code of the MarigoldShare app or platform.
- Interfere with, disrupt, or attempt to gain unauthorized access to any part of the Services or its infrastructure.
- Use the Services to distribute spam, phishing messages, malware, or other harmful content.
- Circumvent any security, rate-limiting, or access control features of the Services.
- Use the Services to test vulnerabilities without express written authorization from Marigold Intelligence LLC.

### 3.6 Commercial Misuse

You may not:

- Use the Services to operate a commercial lending or rental business (i.e., lending Items primarily for profit rather than community sharing) except as expressly permitted under future platform features that specifically authorize such use.
- Resell, sublicense, or exploit any part of the Services for commercial purposes without our express written consent.
- Use the platform to promote competing services or redirect Members to other platforms for commercial gain.

### 3.7 Inappropriate Content

You may not post or share:

- Content that infringes any third party's copyright, trademark, patent, trade secret, or other intellectual property rights.
- Sexually explicit, graphic violence, or otherwise offensive content.
- Personally identifiable information about another Member without their consent (e.g., posting someone's home address, phone number, or financial details).
- Content that advocates for illegal activity or harm to any person or group.

## 4. Permitted and Prohibited Item Categories

### 4.1 General Principle

MarigoldShare permits the listing and borrowing of any physical Item that can be legally owned and lent between individuals, subject to the restrictions in this Section. The platform's default position is permissive — if an Item is legal to own and lend and is not excluded below, it may be listed.

### 4.2 Replacement Cost Ceiling

No Item with a declared replacement cost exceeding **$300** may be listed on the platform. The platform will automatically reject listings above this threshold. This ceiling applies regardless of the Item's actual fair market value. Lenders who knowingly misrepresent replacement cost to circumvent this ceiling are in violation of this AUP and the Community Bylaws.

Items whose fair market replacement value genuinely exceeds $300 are not suitable for this platform at this time. Future platform features may accommodate higher-value Items under separate terms.

### 4.3 Permitted Item Categories

The following categories are explicitly permitted and represent the core use cases of the platform. This list is illustrative, not exhaustive:

- Hand tools, power tools, and garden equipment.
- Sports and recreational equipment (bicycles, skis, kayaks, camping gear, etc.).
- Musical instruments and audio equipment.
- Baby and child equipment (strollers, car seats, high chairs, toys, games).
- Party, event, and catering supplies.
- Kitchen and household appliances.
- Photography and video equipment.
- Books, board games, and educational materials.
- Luggage and travel accessories.
- DIY, craft, and hobby supplies.

### 4.4 Prohibited Item Categories

The following categories of Items may not be listed, lent, or borrowed under any circumstances:

- **Weapons:** Firearms, ammunition, knives designed primarily as weapons, tasers, pepper spray, or any item designed to cause bodily harm.
- **Controlled substances:** Illegal drugs, prescription medications, or paraphernalia related to illegal drug use.
- **Recalled or unsafe Items:** Any Item subject to a current safety recall notice or known to have unaddressed safety defects.
- **Licensed-use Items:** Items that require a government-issued license or professional certification to legally operate or possess, unless both parties have verified in writing that the Renter holds the required credential (e.g., certain heavy machinery, commercial equipment, or regulated devices).
- **Consumables and perishables:** Food, beverages, medicine, fuel, or any Item that is used up or significantly degraded through normal use, making return in original condition impossible.
- **Digital goods:** Software licenses, streaming accounts, digital files, access credentials, or any non-physical item.
- **Living animals:** Pets or any other living creature.
- **Real property:** Land, rooms, vehicles registered as real property, or any item governed by landlord-tenant or real property law.
- **Stolen or encumbered Items:** Any Item that is stolen, subject to a lien, subject to a legal claim, or that the Lender does not have full authority to lend.
- **Items of extraordinary value:** Items whose genuine fair market replacement value exceeds $300, regardless of the declared replacement cost entered at listing.

## 5. Reporting Violations

If you become aware of a violation of this AUP, you are encouraged to report it using the in-app reporting feature or by contacting us at **ubertool320@gmail.com**. We take all reports seriously and will investigate promptly.

We appreciate reports made in good faith, but filing a false report against a Member is itself a violation of this AUP.

## 6. Consequences of Violations

Violations of this AUP may result in one or more of the following actions, depending on severity:

- A warning issued to the violating Member.
- Temporary suspension of account access.
- Removal of offending content or listings.
- Permanent termination of the Member's account.
- Referral to law enforcement where illegal activity is suspected.

MarigoldShare reserves the right to investigate suspected violations and take appropriate action at its sole discretion. We are not obligated to provide advance notice before taking action, particularly in cases involving safety, fraud, or illegal activity.

## 7. Appeals

If you believe your account was suspended or content was removed in error, you may submit an appeal to **ubertool320@gmail.com** within **30 days** of the action. Please include your account information and a description of why you believe the action was incorrect. We will review your appeal and respond within a reasonable time.

## 8. Changes to This AUP

We may update this AUP from time to time. Material changes will be communicated via in-app notification. Your continued use of the Services after the effective date of any update constitutes acceptance of the revised AUP.
